I think the final opinion of Judge Kollar-Cotelly on the DOJ-Microsoft settlement was very appropriately rendered on Halloween. This "comeback of the dead 1995 consent decree" deserves indeed a place of honor among the folklore characters to be found around in the streets during these festivities.
So, US Justice closes the thick Microsoft files confirming that this firm, indeed, is guilty of illegally maintaining its monopoly, illegally strong-arming OEMs, illegally sabotaging competitors, etc.
but lacks the strength to apply remedies appropriate to the offense. This is surely understandable if one takes into account the current political context, where no US strategical advantage may be easily sacrified, and the current economical conjuncture, where dismembering Microsft would have probably sent the Nasdaq down a steep hill (see here a curious bit of information about how some people made a nice financial benefit out of a leaked-before-schedule copy of this Halloween zombie). But this also means that we can no longer trust the US Justice with the defence of our rights ("our", here, means people all around the world, including the US), and my modest contribution is the opening of this WebLog, that marks in a sense a little comeback for me too, after too short a retirement from the front scene.
